GC 57 6 Public Entity Crimes By executing a Contract with Owner, Contractor certifies, in <br />accordance with F.S 287 133, that Contractor, its affiliates, suppliers, subcontractors and consultants <br />who will perform under this Agreement have not been placed on the convicted vendor list maintained <br />by the State of Florida Department of Management Services within the 36 months immediately <br />preceding the date of the Invitation to Bid <br />GC 57 7 Compliance with Laws. Contractor shall comply with all applicable County, State and <br />Federal laws relating to the provision of services under this Contract, now or hereafter in effect. <br />Contractor shall comply with all applicable County, State and Federal laws relating to wages, hours, <br />and all other applicable laws relating to the employment or protection of employees, now or hereafter <br />in effect. It shall not be grounds for a change order that Contractor failed to investigate the codes and <br />regulations of all applicable government agencies with jurisdiction over the work. <br />GC 57.8 Small Business Requirements. Contractor shall comply with the County's Small <br />Business Ordinance set forth in Chapter 66 of the County Code, which is incorporated herein by <br />reference <br />GC 57.9 No Solicitation. Contractor has not employed or retained any person employed by the <br />Owner to solicit or secure the Contract and it has not offered to pay, paid, or agreed to pay any person <br />employed by the Owner any fee, commission percentage, brokerage fee, or gift of any kind contingent <br />upon or resulting from the award of this Agreement. <br />GC 57 10 Non -Collusion Contractor certifies that it has entered into no agreement to commit a <br />fraudulent, deceitful, unlawful or wrongful act, or any act which may result in an unfair advantage over <br />other bidders or contractors. (F.S. 838.22) <br />GC 57.11 Equal Employment Opportunity; Non -Discrimination. Contractor will not discriminate <br />against any employee or an applicant for employment because of race, color, religion, sex, national <br />origin or handicap. Contractor shall take affirmative action to ensure that applicants are employed <br />and that employees are treated fairly during employment without regard to race, color, religion, sex, <br />natural origin or handicap <br />GC 57 12 Apprentices. If the Contractor employs apprentices on the project, the behavior of <br />the Contractor and the Owner shall be governed by the provisions of Chapter 446, Florida Statutes, <br />and by applicable standards and policies governing apprentice programs and agreements established <br />by the Division of Labor of the State of Florida Department of Labor and Employment Security. The <br />Contractor will include a provision similar to the foregoing sentence in each subcontract. <br />GC 57.13 Unauthorized Aliens. The Owner shall consider the employment by Contractor or its <br />subcontractors, any alien not authorized to work by the immigration laws or the Attorney General of <br />the United States. Such violation shall be cause for unilateral cancellation of this contract. <br />GC 57 14 Right to Audit. Contractor shall maintain adequate records of the services for at least <br />three (3) years from project occupancy Owner, during Contractor's business hours and with at least <br />24 hours prior notice to Contractor, shall have the right to audit the Contractor's books and records, at <br />the Owner's expense, with regard to the accounts and services provided to or on behalf of the Owner <br />hereunder to ensure that all aspects of the Contract are being met. Failure by Contractor to permit <br />such audit shall be grounds for termination of this Agreement by the Owner <br />GC 57.15 Independent Contractor. Contractor represents that it is properly experienced, <br />licensed, equipped and financed to perform the work. Contractor acknowledges and agrees that it is <br />an independent contractor of the Owner and is not an employee of the Owner and shall maintain <br />control over its employees, subcontractors and work methods Contractor more specifically <br />acknowledges that it: will not be eligible to participate in any employee benefit maintained by the <br />Owner; will not be covered by the Owner's workers' compensation insurance; and will be solely and <br />exclusively responsible for payment of all federal and state income, social security, unemployment <br />46 <br />
