AUG 13 i9as <br />BOOK F}1,c <br />DESCRIPTION AND CONDITIONS <br />The subdivision ordinance, as amended July 17, 1985, allows for <br />the platting of unimproved private road rights-of-way if there is <br />no subdivision of property (as defined in the ordinance). Under <br />these provisions the platted private rights-of-way, though exempt - <br />from road and drainage requirements, must meet County standards in <br />regards to the following: <br />1. relationship to existing streets and drives; <br />2. location; and <br />3. dimensions (widths and lengths) <br />Creating such private road rights-of-way provides parcels with <br />frontage on privately dedicated (owned and maintained) roads. The <br />creation of road frontage allows for building permits to be issued <br />on parcels that currently have no dedicated road frontage, and <br />provides the necessary space and layout for possible future <br />improvements that can satisfy County road, drainage, and utility <br />requirements. <br />The applicant, Bruce Smith, acting on his own behalf and on the <br />behalf of Bill Jaap and Arthur Ogonoski, owners, is now requesting <br />final plat approval for Pine Cone Lane, a proposed east -west <br />private road right-of-way extending west of 39th Avenue S.W. and <br />aligned with, 11th Street S.W. The submitted final plat is in <br />conformance with the preliminary plat that was approved by the <br />Planning and Zoning Commission at their July 24, 1986 regular <br />meeting. <br />ALTERNATIVES AND ANALYSIS <br />The proposed private road right-of-way will be able to serve the <br />residentially zoned area north of the Shady Oaks subdivision and <br />south of Oslo Road. The private road will be established in such <br />a way that adjacent property owners will be able to use it and <br />extend it in the future. The Public Works and Utilities depart- <br />ments have approved the application for final plat approval. <br />A private property owners'' association will be formed to own and <br />maintain .the road right-of-way. No subdivision of property, as <br />defined in the subdivision ordinance, is to occur. <br />All applicable County regulations have been satisfied in regards <br />to final plat approval. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners grant <br />final plat approval for the Pine Cone Lane road plat. <br />ON MOTION by Commissioner Lyons, SECONDED by <br />Commissioner Bird, the Board unanimously granted <br />final plat approval for Pine Cone Lane road plat, <br />as recommended by staff. <br />14 <br />
