Wayay 11" nt REFERENCES: <br />DESCRIPTION &.CONDITIONS <br />Attorney Michael O'Haire represents Mr. & Mrs. Richard Zorc on two <br />right of way parcels. The staff has been in lengthy negotiations with <br />Mr. O'Haire to arrive at an agreed settlement. <br />The Zorc's are willing to settle for Mr. Armfield's appraised.:value- <br />of the parcels and construction of 8 paved parking spaces on another <br />part of the parent property as compensation for the parking spaces which <br />currently encroach upon the right of way. <br />Parcel #162 Appraised value $10,072.00 <br />Parcel #163 Appraised value 656.00 <br />$10,728.00 <br />RECOMMENDATIONS <br />Staff request authorization to purchase the right of way at the <br />appraised values and authorize the county constructi9n of 8 paved <br />parking spaces. <br />Should the property owner rescind his willingness to the above <br />settlement, then staff is requesting condemnation authorization. <br />FUNDING <br />Indian River Boulevard South #304-214-541.066.12 <br />Commissioner Wodtke understood that we are buying <br />right-of-way at the raw land value of $10,728 in addition to <br />building 8 parking spaces for the owner, and Public Works <br />Director Jim Davis explained that we are trying to work with the <br />property owner so that he retains the same parking area and we <br />get the right-of-way at a fair price. <br />Don Finney, County Right -of -Way Agent, advised that the <br />property owners' attorney has indicated that they are willing to <br />7 <br />AUG( 6 19 <br />Boaf 5 u 3E 497 <br />
