DEPARTMENT OF ENVIRONMENTAL REGULATION APPLICATION <br />FILE NO. 31-123742-4 <br />- Applicant: Kelly Lloyd, 98 Springlake Drive, Vero Beach, <br />Florida, 32963. <br />Waterway & Location: The project is located in the Indian <br />River in Castaway Cove Subdivision, adjacent to Lot 56, <br />Section 31, Township 33 South, Range 39 East, Indian River <br />County, Florida. The upland property associated with the <br />project is located in the City of Vero Beach. <br />Work & Purpose: The applicant proposes to construct a <br />private single 4' x 40' dock with a 20' x 8' observation <br />deck for a total of 380 square feet. No sewage pump -out <br />or fueling facilities are proposed. No dredging or <br />filling will be performed. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />The Hutchinson Island Planning & Management Plan <br />The Indian River County Code'of Laws and Ordinances - <br />The project is located in the City of Vero Beach. Therefore, <br />the focus of staff review is on potential County and_regional <br />impact rather than site-specific impact; an in-depth field <br />inspection of the project site was not conducted. <br />Chapter 16Q-20 of the Florida Administrative Code sets para- <br />meters for private residential single docks located in the <br />Indian River Aquatic Preserve. Section 16Q -20.04(5)(b), <br />Florida Administrative Code, sets forth specific design stan- <br />dards and criteria for private single docks. - <br />Although the extent of any impacts are not fully known at this <br />time, there may be cumulative impacts of this and other dockage <br />projects proposed to be constructed along the Indian River upon <br />the Florida Manatee. <br />RECOMMENDATION: <br />It is recommended that the Board of County Commissioners <br />authorize staff to forward the following comments regarding <br />these projects to the Florida Department of Environmental <br />Regulation: <br />1) The Department of 'Environmental Regulation and other <br />appropriate agencies should coordinate with the D.N.R. to <br />determine if the proposed project is located in the Indian <br />River Aquatic Preserve and therefore subject to require- <br />ments of Chapter 16Q-20, Florida Administrative Code; <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential cumu- <br />lative impacts of dockage projects upon the Florida <br />Manatee; <br />3) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of marina projects on ecologically significant submerged <br />bottomlands such as seagrass beds in the Indian River. <br />Sp 2 1906 12a BOOK 65 f'.,E549 <br />L_ <br />
