DeBraal, Deputy County Attorney <br />DATE: January 14, 2015 <br />SUBJECT: Approval of Agreement for Payment of Costs Associated with Creation of the <br />Oslo Park Area Street Lighting Municipal Service Benefit Unit <br />Oceanside Subdivision Street Lighting Municipal Service Benefit Unit <br />Oceanside Subdivision Street Paving and Maintenance Municipal Service Benefit Unit <br />County staff is proposing the creation of three new Municipal Services Benefit Units (MSBU) to <br />provide street lighting improvements in Oceanside Subdivision and the Oslo Park area, and an <br />Oceanside Subdivision street paving and maintenance MSBU. Indian River County Code provides <br />establishment of street lighting and street paving and maintenance districts for collection of non -ad <br />valorem assessments pursuant to the uniform method found in Florida Statute §197.3632. In order to <br />comply with this statute, the County must enter into a written agreement with the Property Appraiser <br />and Tax Collector providing for reimbursement of their necessary administrative costs incurred in <br />creating the MSBU, including costs associated with personnel, forms, supplies, data processing, <br />computer equipment, postage, and programming. <br />The Oslo Park area is made up of mostly residential neighborhoods with narrow, unlit dirt roads. The <br />proposed MSBU will provide for installation and maintenance of approximately 86 street lights. <br />Oceanside Subdivision was platted in 1979 and did not include street lights in the development of the <br />property. The new MSBU proposes 10 street lights. The streets in Oceanside are in need of <br />repaving and the MSBU will provide funds for street improvements. <br />Attached you will find a proposed agreement that has been signed by the Property Appraiser and Tax <br />Collector. The agreement simply recites that the Board will reimburse the Property Appraiser and <br />Tax Collector for necessary administrative costs incurred in collecting the non -ad valorem <br />assessments for the three proposed MSBUs. The agreement also establishes March 1, 2015 as the <br />deadline for adopting the required resolution. Normally, non -ad valorem assessment resolutions <br />must be approved prior to January 1 for inclusion in the upcoming tax year, however, the statute does <br />allow the deadline to be extended to March 1 with approval of all parties.
