DeBraal, Deputy County Attorney <br />DATE: January 14, 2015 <br />),Pip <br />SUBJECT: Public Hearing for Approval of a Resolution Electing to Use the Uniform <br />Method for the Levy, Collection and Enforcement of Non Ad Valorem <br />Assessments for the Oceanside Subdivision Street Lighting Municipal Service <br />Benefit Unit <br />County staff is proposing the creation of a new Municipal Services Benefit Unit (MSBU) to recover the <br />;osts of street lighting improvements in the Oceanside Subdivision. The area is made up of a <br />residential subdivision platted in 1979, prior to current land development regulations. Current code <br />requires new subdivisions to provide for street lighting within the development. Oceanside <br />Subdivision consists of 42 platted lots. Since it was developed prior to modern land use regulations, <br />the private streets are narrow and unlit. The proposed MSBU covers installation and maintenance <br />costs of ten proposed street lights. Indian River County Code provides for the establishment of street <br />lighting districts by ordinance and for collection of non ad valorem assessments pursuant to the <br />uniform method found in Florida Statute §197.3632. <br />In order to formally establish the MSBU, the Board will need to hold two public hearings. At this first <br />Public Hearing, the Board is asked to adopt the attached resolution which states the following: <br />• the Board intends to use the uniform method of collecting the non ad valorem assessments <br />found in Florida Statute §197.3632, and <br />• the Oceanside Subdivision Street Lighting MSBU is necessary to improve the health safety <br />and well being of those residing and owning property within the boundaries of the district. <br />Notice of the Public Hearing has been advertised in the Press Journal for the past four consecutive <br />weeks. <br />ear- t' <br />124 <br />
