DeBraal, Deputy County Attorney i <br />DATE: January 14, 2015 <br />SUBJECT: Public Hearing for Approval of a Resolution Electing to Use the Uniform <br />Method for the Levy, Collection and Enforcement of Non Ad Valorem <br />Assessments for the Oslo Park Area Street Lighting Municipal Service <br />Benefit Unit <br />County staff is proposing the creation of a new Municipal Services Benefit Unit (MSBU) to recover the <br />:osts of street lighting improvements in the Oslo Park area. Oslo Park was platted in several units in <br />1955, prior to current land development regulations. Current code requires new subdivisions to <br />provide for street lighting within the development. The rough boundaries of the proposed MSBU <br />extend from 17th Street SW north to 7th Street SW and 27th Avenue SW east to the Lateral J Canal. <br />The streets are all dedicated as public streets throughout the various units of the subdivision. Since <br />Oslo Park was developed prior to modern land use regulations, most of the streets are narrow and <br />unlit. The proposed MSBU covers installation and maintenance costs of 86 proposed street lights. It <br />is estimated that 1,600 property owners will be affected by this MSBU. Indian River County Code <br />provides for the establishment of street lighting districts by ordinance and for collection of non ad <br />valorem assessments pursuant to the uniform method found in Florida Statute §197.3632. <br />In order to formally establish the MSBU, the Board will need to hold two public hearings. At this first <br />Public Hearing, the Board is asked to adopt the attached resolution which states the following: <br />• the Board intends to use the uniform method of collecting the non ad valorem assessments <br />found in Florida Statute §197.3632, and <br />• the Oslo Park Street Lighting MSBU is necessary to improve the health, safety and well being <br />of those residing and owning property within the boundaries of the district. <br />Notice of the Public Hearing has been advertised in the Press Journal for the past four consecutive <br />weeks. <br />Nor - <br />136 <br />
