Memo <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of September 30, 1986. <br />DESCRIPTION & CONDITIONS <br />Subsequent to the County rezoning all of the unincorporated areas <br />of the County in conformance with the Comprehensive Plan, several <br />problems have arisen in developing lots -of -record which have an <br />LD -1 land use designation (allowing up to 3 units/acre) and which <br />are now zoned RS -3, Single -Family Residential District (upr to 3 <br />units/acre). Many of these lots were platted under the old R-1, <br />Single -Family District (up to 6 units/acre), regulations and some <br />RS -3 zoned lots were platted prior to the County having a zoning <br />ordinance. Many of these lots cannot meet the minimum size or <br />dimension criteria of the RS -3 district so are nonconforming <br />lots -of -record. The main problems are that the new RS -3 district <br />requires a minimum dwelling unit size of 1200 square feet and a. <br />minimum side yard setback of 15 feet. The old R-1 zoning <br />district had a minimum dwelling unit size of 750 square feet and <br />a minimum side yard setback of 10 feet. Moreover, the RS -3 <br />district has a minimum lot width of 80 feet while the old R-1 <br />district had a minimum lot width of 70 feet and several of the <br />nonconforming lots -of -record in the RS -3 district were platted <br />before the County had a zoning ordinance and are only 60 feet <br />wide. Property owners have complained about 15 foot side yard <br />setbacks on 60 foot wide lots which limit the width of houses to <br />30 feet. However, the largest problem has been in Vero Lake <br />Estates where property owners are complaining about having to <br />construct 1200 square foot houses on $2,500 lots. <br />On August 28, 1986, the Planning and Zoning Commission voted <br />5 -to -0 to recommend approval of this request. <br />ALTERNATIVES & ANALYSIS <br />The planning staff feels that the RS -3 regulations are creating <br />unnecessary hardships for many property owners who have <br />nonconforming lots -of -record which were not designed to meet the <br />RS -3 minimum requirements. While the staff feels that the RS -3 <br />regulations are appropriate for the majority of the land <br />designated as LD -1 on the Comprehensive Plan and that the RS -3 <br />regulations should be applied to future subdivisions, some relief <br />is necessary for the nonconforming lots -of -record which cannot <br />meet the new RS -3 requirements. <br />In order to grant some relief without damaging the integrity of <br />the RS -3 district, staff -has prepared a proposed amendment to the <br />RS -3 district which would allow nonconforming lots -of -record <br />which are 70 feet or less in width to have their minimum side <br />yard setback reduced to 10 feet. The proposed amendment would <br />also reduce the minimum dwelling unit size for nonconforming <br />lots -of -record to 900 square feet. <br />59 <br />SEP 30 M6 aOu.. a F k,,; .. 894 <br />
