Discussion ensued in regard to how we insure that these <br />residents can continue to maintain their use of the access, and <br />Attorney Vitunac advised that the church can enter into an access <br />agreement with anyone who has a problem. <br />Commissioner Lyons felt that should have been done before we <br />proceed with the abandonment, and Attorney Vitunac noted that the <br />Board could make the abandonment subject to the church making <br />such agreements. <br />The Chairman asked if anyone present wished to be heard. <br />David Rever of Carter Associates came before the Board <br />representing the church and confirmed that the church intends to <br />work with those who have a problem re use of the alleyway. <br />They do need the additional property, and they would certainly <br />ask that the Board approve the abandonment with the condition <br />that the church grant an easement so these people can continue <br />their use of the alleyway. <br />Commissioner Bowman felt if there are five lots involved, <br />they should all have that right. <br />ON MOTION by Commissioner Lyons, SECONDED by <br />Commissioner Bird, the Board unanimously (4-0) closed <br />the hearing. <br />ON MOTION by Commissioner Lyons, SECONDED by Com- <br />missioner Bowman, the Board unanimously adopted <br />Resolution 86-85 abandoning the 16' alley as re- <br />quested by the Roseland United Methodist Church <br />with the understanding the church will grant ease- <br />ments to all the lots backing on that alley for <br />access. <br />87 <br />noD f � <br />
