0 CT 14 1966 BOOK 66 <br />various County needs. That IBM system replaced a prior system, <br />which he understood goes back to a series of systems dating_back <br />to the 1960s. Since those systems have been in operation, they <br />have always been under the direction and control the Clerk, and <br />she has employed the people who operate that system. <br />Attorney Polackwich continued that Mrs. Wright has been <br />employed in the Clerk's office since the early 40s and has been <br />the Clerk of the Circuit Court for about 10 years, and it is her <br />position that her ability to control the people who operate the <br />data processing system is essential to her discharge of her <br />constitutional responsibilities. Under the central organization <br />that is being discussed, the people who operate that system would <br />suddenly come under the control of the County Administrator, and <br />the Clerk does not want to have to rely,on the cooperation that _ <br />may or may not exist between her office and the County <br />Administrator to ensure her ability to get to the computer to do <br />what she feels has to be done. Although we now have a new County <br />Administrator, there have been problems in the past. The new <br />relationship has not been really defined as yet, and it is not <br />something on which she wants to hedge her abilities. Therefore, <br />the Clerk's position is as follows: <br />1. She does not oppose a unified system. She is willing <br />to work with the County if it is in the best interests <br />of the County to come up with a unified system. <br />2. She will not agree, however, to any unified system that <br />takes that system away from her and puts it under the <br />control of somebody else, with the result that she will <br />have to go through an independent third party not <br />answerable or employed by her to get to the computer. <br />3. If the County Commission decides that they own the system <br />and are going to take it over, the Clerk has instructed <br />her attorney to do all the research necessary to <br />determine whether or not the County Commission has a <br />lawful right to do so, and if he concludes that they do <br />not have that right, she will take whatever steps are <br />necessary to protect her ability to perform her <br />constitutional responsibilities. <br />Attorney Polackwich stressed that the Clerk does not oppose <br />the central organization, but there must be some way to bring <br />28 <br />� � r <br />
