acreage, and the channel is basically closed off from the <br />wetlands system with the exception of a canal and 3 culverts. <br />Everything in the plan is to be done in the natural way and <br />nothing artificial as far as water movement is concerned. One <br />thing that has remained constant in the developer's plan is the <br />filling in of the non-exempt wetlands. Mr. Challacombe pointed <br />out the non-exempt and exempt wetland areas on the developer's <br />plan and emphasized that the each jurisdictional agency reviewing <br />this application has their own boundaries for wetland under their <br />permitting process. <br />The exempt wetlands are the ones that are highly altered and <br />are very difficult to restore. Basically, the developer can work <br />within those exempt areas with regard to fill and creating his <br />project. In return the developer will stay out of the non-exempt <br />areas. Referring to the developer's plan, he pointed out the <br />subject 12 acres of non-exempt wetlands. Mr. Challacombe stated <br />that right from the beginning the Planning staff has informed the <br />developer that this change is a deviation from the Development <br />Order and would requir.e the approval of the Board of County <br />Cornmissioners. `Staff is recommending that the Board amend the <br />.Development Order and approve the estuarine plan subject to the <br />conditions proposed by staff in the above memo. <br />Mr. Challacombe then reviewed the status on the following <br />issues: <br />D.O. Amendment -- The developer is requesting to be allowed to <br />fill in 10 acres of existing high marsh in the non-exempt area <br />for a golf course plus another 2 acres for road fill. As a <br />whole, the environmental benefits would be that the developer has <br />an incentive to spend the money to restore the total wetland <br />system.
