Nearing REFERENCES: Kouspos <br />Staff Planner 0&.64 DAVE3 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of October 28, 1986. <br />DESCRIPTION AND CONDITIONS: <br />Mr. & Mrs. Vincent Kouspos have submitted a right-of-way <br />abandonment petition requesting that the County ab --don a portion <br />of 1st Place, also known as Cobie Circle, which 1_es within the <br />Indian River Heights Subdivision Unit #4. Even though this <br />portion of right-of-way has been improved to marl road standards, <br />and is maintained by the County, it is the belief of the <br />petitioners that this right-of-way's infrequent use and the lack <br />of use for access onto any properties makes its existence <br />unnecessary. <br />The petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way, as per <br />guidelines established by the Board of County Commissioners for <br />processing right-of-way abandonment applications. All reviewing <br />agencies, which included the Public Works Division, the Utilities <br />Division, Florida Power and Light and Southern Bell, recommended <br />approval of the petition. for abandonment. However, the County <br />Public Works Department and several other utility providers have <br />requested a 20 ft. wide easement across that portion described as <br />10 feet either side of the rear lot lines projected between Block <br />"C" to the south and Block "H" to the north. The petitioners are <br />in agreement with the request. <br />ANALYSIS <br />The 70 ft. wide partially improved right-of-way is not part of the <br />roadway system noted on the County Thoroughfare Plan, and its need <br />as such is not anticipated. <br />Upon examining this request, staff concluded that because of the <br />angle at which this portion of 1st place intersects with 14th. <br />Avenue to the east, any improvement of this road which might <br />increase traffic could cause a dangerous situation with conflicts <br />between southbound 14th Avenue traffic turning right to go west on <br />1st Place and eastbound 1st Place traffic turning left across the <br />westbound lane onto 14th Avenue to head north. Abandonment would <br />also relieve the County from further maintenance of this 280 foot <br />portion of right-of-way. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to the 70 ft. <br />wide portion of 1st Place known as Cobie Circle, with the <br />exception of the requested drainage and utility easement, and <br />authorize the Chairman of the Board of County Commissioners to <br />execute the attached Resolution (Attachment #3). <br />E s 44 BOOK 66 uu- 244 <br />
