believed if the tankers are filled just by flow there shouldn't <br />be any damage; it is a question of sucking on the line. However, <br />he felt the Board should go on record recognizing the problem is <br />there and not condone it simply to limit any liability. <br />Commissioner Lyons noted that we have a representative of <br />the North County Fire District present on the Board, and he felt <br />there should be instructions issued that you don't pump from this <br />line but just use the free flow of the fire hydrant to fill the <br />tank. <br />After some discussion, Chairman Scurlock felt he had gotten <br />a consensus of the Board that that's the line we want to follow. <br />Director Pinto stressed that•the problem is that he could <br />not advise the Commission to ignore the order of the DER. <br />Commissioner Lyons asked why we can't tell them that we will <br />advise the fire district not to suck on the lines andwillissue <br />instructions that they simply use the normal pressure of the line <br />to fill their tanks. <br />Director Pinto advised that staff already told the DER that <br />the hydrants served a purpose in flushing the system out, but <br />— they d ridn' t—buy -that. <br />Commissioner Bowman noted a new firehouse is being built on <br />Barber Ave. She found it hard to believe there isn't a single <br />fire hydrant in Sebastian Highlands, and if not, why not. <br />Chairman Scurlock felt the question was the proximity of the <br />hydrant to the fire, and Director Pinto stated they would look <br />into this further. <br />Attorney Steve Henderson came before the Board representing <br />James Wilson and Breezy Village Water Company. He noted that he <br />has been discussing with Attorney Vitunac whether the franchise <br />as amended really made them meet fire flows, but he believed Mr. <br />Wilson is willing to keep the hydrants in there until the DER <br />starts charging $10,000 a day fines, and then he will pull them <br />out.
