IBMIRD <br />Environmental Planning Section <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting on November 18, 1986. <br />DESCRIPTION & CONDITIONS: <br />On October 16, 1986)County staff observed that parcel number <br />9-32-39-00001-0130-00001.0 had been cleared, including the <br />removal of sixteen (16) protected trees prior to the issuance <br />of tree removal and landclearing permits. The parcel is <br />approximately 10.00 acres in size, and is located on the south <br />side of North Winter Beach Road (69th Street), approximately <br />1000' east of King's Highway (58th Avenue). The property is <br />zoned RS -3, Single Family Residential District. <br />In addition, staff observed that the landclearing and tree <br />removal had occurred in association with the development of two <br />(2) ponds, and for the future establishment of a right-of-way; <br />each was performed without County approval. <br />The property is currently owned by Mr. Al Fuster; the land - <br />clearing was performed by -a Mr. Ron Ward of 3970 6th Street, <br />Vero beach, Florida. <br />In an on-site meeting with staff on October 16, 1986, Mr. Pete <br />Fuster, brother of the landowner, explained that the property <br />had been cleared for the construction of a single family house, <br />and for the establishment of two (2) ponds. He also indicated <br />that some of the clearing was related to the possible future <br />development of a right-of-way for a subdivision development. <br />Pete Fuster indicated that neither he nor his brother were <br />aware of the need for permits for the landclearing or tree <br />removal. <br />In addition, Mr. Fuster explained that the majority of pro- <br />tected trees removed were. -from the location of the single <br />family house and from the location of the two (2) ponds being <br />developed. According to Mr., Fuster, the ponds were being <br />established in areas where land elevation reflected natural <br />depressions. Staff was unable to determine specifically where <br />each of the sixteen protected trees existed prior to their - <br />removal. However, based upon staff's field inspection, staff <br />has been able to delineate the general areas on which the <br />illegal clearing took place (see attachment). <br />Mr. Fuster has acquired the services of Carter and Associates <br />to apply for after -the -fact permits for the proposed land <br />development. <br />75 <br />®V � � a��6 BOOK 66 F',{�E 44 <br />I� . <br />
