ABERNETHY, FRANCHISE MANAGER c� <br />DIVISION OF UTILITY SERVICES (J� <br />SUBJECT: RURAL SANITATION SERVICE <br />BACKGROUND AND CONDITIONS <br />On May 21, 1986, the Board of County Commissioners passed Resolution <br />No. 86-31 which prohibits sanitation haulers from picking up trash <br />before 6:00 A.M. or after 9:30 P.M. <br />Since that time, Rural Sanitation Services has not abided by this <br />franchise requirement. Early hour collection has continued and <br />complaints are being filed. Utility staff has written numerous <br />letters and has contacted Rural Sanitation about this violation. <br />Utility staff has even contacted the Indian River County's Sheriff's <br />Department and instructed them to issue warning tickets if the trucks <br />are present in residential areas before 6:00 A.M. <br />Utility staff has reprimanded Rural Sanitation Services time and time <br />again and has warned the company that they were jeopardizing their <br />franchise by not complying with the franchise regulations. <br />RECOMMENDATION <br />Utility Staff requests the Board of County Commissioners to set a <br />date for a public hearing to determine the course of action to be <br />taken against Rural Sanitation Services. <br />Mrs. Abernethy informed the Board that the Sheriff feels it <br />is unfair to regulate only residential and not commercial pickup, <br />and she agreed we need to have the commercial pickup adjusted to <br />6:00 A.M. also because many residential areas, such as those near <br />Ryanwood Shopping Center, back up to commercial areas. She <br />further advised that within the last two weeks, Utilities has had <br />46 <br />
