The point <br />is that the Utilities Department has had solid residential areas <br />complain, and the Utility Department even had the County Attorney <br />send Rural Sanitation a letter telling them they were <br />jeopardizing their franchise. <br />Attorney Jackson stated that he had never seen that letter, <br />and Attorney Vitunac felt if the company didn't forward the <br />letter to Attorney Jackson, that is their problem. <br />Commissioner Eggert inquired if Attorney Vitunac's letter <br />was sent,by certified mail, and Mrs. Abernethy stated that she <br />sent a certified letter, but did not know if the Attorney's <br />letter was certified. <br />Utilities Director Pinto informed the Board that his <br />department has talked to Rural Sanitation several times, and he <br />did not care if we have a public hearing or not, but something <br />must be done. The commercial pickup is an issue also. Director <br />Pinto felt 6:00 A.M. should be the earliest time for pickup <br />anywhere in the county, and if it takes more trucks or more <br />personnel, that is what they will have to do. <br />The Board indicated they would have a public hearing to <br />change the hours as indicated by Utilities staff, and in between <br />that time, indicated that if Rural Sanitation does not cease to <br />pick up in violation of the hours set by the ordinance, they will <br />give serious consideration to invalidating their franchise. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously authorized <br />staff to draw up an ordinance as discussed. <br />48 <br />
