Commissioner Wheeler noted that there is no county ordinance <br />preventing transporting of unsealed alcoholic beverages in <br />automobiles and no state or county law prohibiting consumption in <br />semi-public parking lots. The City of Vero Beach and City of <br />Sebastian have adopted similar ordinances of this type, and Com- <br />missioner Wheeler felt if the County adopted one, it would give <br />the law enforcement agencies some teeth to prevent this from <br />occurring in places such as Mr. Miller's, for instance. He <br />stated that he would like to pursue this and have staff draw up <br />an ordinance for the Board to consider. <br />Commissioner Bowman asked if he meant just public parking <br />lots as she believed store lots are privately owned. <br />Attorney Vitunac clarified that it would be privately owned <br />parking lots the public has access to. <br />Chairman Scurlock asked if the ordinance would apply to <br />recreational vehicles, and Commissioner Wheeler believed it would <br />apply to any vehicle. <br />The Chairman felt this is just another way to discourage <br />people from drinking while they are driving, and he asked if <br />there are any statistics to show that there have been fewer <br />accidents where such a law has been passed. <br />Commissioner Wheeler did not have any such statistics, but <br />felt anything that discourages people from drinking while driving <br />is beneficial. <br />Chairman Scurlock asked if this actually can be enforced, <br />and Commissioner Wheeler felt it can from the standpoint that it <br />gives the officer probable cause to stop the vehicle. <br />Commissioner Bird asked how far we would propose to go re <br />the type of vehicle - any wheeled vehicle, motorcycle, bicycle, <br />etc., and Commissioner Bowman noted that she would like to see <br />boats included. <br />Attorney Vitunac stated that he would bring back a draft of <br />an ordinance for the Board to review before advertising a public <br />hearing. <br />51 BOOK 6 i'mu,. 5 7 <br />DECa �� <br />
