DEC � 1986 <br />o <br />BOOK <br />1. Resolution 86-4 (February, 1986) adopted pursuant to request <br />by the Treasure Coast Regional Planning Council to add <br />conditions relating to boat slip leasing, off-site runoff <br />discharge, and shallow acquifer use; <br />2. Resolution 86-89 (October, 1986) adopted pursuant to request <br />by the applicant, (Grand Harbor, Inc.) to allow specified. <br />amounts of fill in certain wetlands. <br />These two amendment requests did not constitute substantial <br />deviations. Substantial deviations are major modifications or <br />additions to a D.R.I. project that require re -review by federal <br />and state agencies as well as formal review and recommendations <br />from the regional planning council. <br />In August of 1986, the applicant applied through T.C.R.P.C. for a <br />s substantial deviation D.O. amendment. Pursuant to substantial <br />deviation procedures and regulations, the T.C.R.P.C. has reviewed <br />and formally recommended that certain amendments to the Grand <br />Harbor D.O. be adopted pursuant to the applicant's request. The <br />County is now responsible for making the final (though appealable) <br />decision regarding the request. <br />County staff has reviewed and analyzed the T.C.R.P.C. report and <br />recommendations (attachment #2) and has drafted a resolution to <br />amend the D.O. <br />ANALYSIS <br />County staff's proposed resolution conforms to the Planning <br />Council's recommendations and adds three items: <br />1. the October 1986 D.O. amendment (Resolution 86-89) is <br />referenced; <br />2. the two conditions relating to additional boat slips are tied <br />to local site plan approval; and <br />3. language is added to the sailboat definition condition that <br />establishes what the definition must describe. <br />With these three additions the proposed amendments grant two <br />requests with conditions. <br />1. The "River Club" area (see attachment #3) totaling ±178.4 <br />acres located immediately west of the existing marina basin, <br />would be added to the D.R.I. project. The River Club is to <br />consist of an 18 -hole golf course, golf club, and 71 single <br />family homes. <br />a) Condition: 53rd Street east of Indian River Boulevard <br />must be paved to the River Club project entrance. <br />2. An additional 72 boat slips would be added to the approved 72 <br />boat slips (total to be 144). <br />a. Condition: the 72 slips would be restricted to use by <br />sailboats. <br />b. Condition: the developer shall define "sailboat" to <br />describe a craft that does not threaten the manatee. <br />The definition would need to be approved by the D.N.R., <br />U.S. Fish and Wildlife Service and the County (in <br />consultation with the T.C.R.P.C.) prior to site plan <br />approval for the marina. <br />C. Condition: the developer will have to provide legal <br />assurances (including the method of enforcement) that <br />the 72 restricted slips will in fact be restricted to <br />use by sailboats only. <br />18 <br />M_, M M <br />
