r <br />DEC 0«, <br />ALTERNATIVES & ANALYSIS: <br />BOOK <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />The Hutchinson Island Planning & Management Plan <br />i - The Indian River County Code of Laws and Ordinances <br />Chapter 16Q-20, Florida Administrative Code <br />The project as proposed is located within the Town of Indian <br />River Shores and therefore is not subject to County Code <br />requirements. <br />Section 16Q-20.04(5) of the Florida Administrative Code sets <br />forth specific standards and criteria for private residential <br />single docks constructed within the Indian River Aquatic <br />Preserve, among which are the following criteria: <br />Any main access dock shall be limited to a maximum width <br />of four (4) feet (Sec. 16Q -20.04(5)(b)(1), F.A.C). <br />Terminal platform size shall be no more than 160 square <br />feet (Sec. 16Q-20.04 (5) (b) (6) , F.A.C.) . <br />Staff have not determined if the project is to be located in <br />the Indian River Aquatic Preserve or on privately owned bottom - <br />lands. If the project is located within the Aquatic Preserve, <br />it does not satisfy the above cited criteria. <br />The extent to which the submerged bottomlands of the proposed <br />project area will be impacted has not been determined; the <br />effect of Indian River development on ecologically valuable <br />seagrass beds should be considered. <br />RECOMMENDATION: <br />It is recommended that the Board of County Commissioners <br />authorize staff to forward the following comments regarding <br />this project to the Florida Department of Environmental Regu- <br />lation: <br />1) The Department of Environmental Regulation and other <br />appropriate agencies should coordinate with the D.N.R., to <br />determine if the project as proposed is located in the <br />Indian River Aquatic Preserve and therefore subject to <br />requirements of Chapter 16Q-20, Florida Administrative <br />Code. <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential cumu- <br />lative impacts of dockage projects upon the Florida <br />Manatee; <br />3) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of marina projects on ecologically significant submerged <br />bottomlands such as seagrass beds in the Indian River. <br />4 <br />
