Balczun <br />County Administrator <br />James W. Davis, P.E. <br />Public Works Director <br />SUBJECT: Indian River Boulevard <br />Project - 6th Avenue Right of <br />Way Acquisition, Parcel #103 <br />FROM: Donald G. Finney, SRA REFERENCES: <br />Right of Way Agent�'� <br />d <br />DESCRIPTION AND CONDITIONS <br />The property owners are willing to sell the 15' x 110' right of <br />way (1,650 sq. ft.) at the $2.50 sq. ft. appraised value of $4,125.00. <br />Additionally the county would relocate the oak trees and shrubs off <br />the right of way, however Mr. George Collins, Trustee and attorney for <br />the property owners is willing to settle for $100.00 for the hedge and <br />$750.00 attorney fee. <br />$4,125.00 Land taken <br />100.00 Hedge <br />750.00 Attorney fees <br />$4,975.00 FULL COMPENSATION <br />RECOMMENDATION AND FUNDING <br />Staff requests authorization to purchase the above parcel #103 at <br />the appraised value, pay the property owner for the hedge and the <br />owner's attorney fee for representing the owners for a total <br />compensation of $4,975.00 <br />Public Works Director Davis noted that we have been very <br />active in securing right-of-way for this project for the last 11 <br />years. Now, however, in the last stage of this acquisition <br />it appears that more and more attorneys are getting involved. He <br />believed property owners are having attorneys because they know <br />it won't cost them anything, and it seems some of the attorney's <br />fees get quite expensive. In this particular case, Director <br />Davis felt a $750 attorney's fee is quite a bit and that possibly <br />we should have an itemized bill. He further noted that this has <br />become a statewide issue, and some are taking the position that <br />69 <br />BOOK 66 f,,vuE 708 <br />
