Kea g, Mcp & 12, WALLACE ACRES SUB - <br />Planning & Development Director DIVISION <br />FROM: Betty Davis REFERENCES: RE/Kelly <br />•Code Enforcement Officer <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of December 23, 1986. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Francis P. and Elizabeth <br />Kelly, owners of the subject property, for the release of the <br />rear lot 10' utility easement of Lots 11 & 12, Wallace Acres <br />Subdivision, being the northerly 10 feet thereof, as recorded <br />in Plat Book 7, Page 12, of the Public Records of Indian River <br />County, Florida. It is the Kelly's intention to consolidate <br />the lots to form one large building parcel. <br />The current zoning classification is CL, Limited Commercial <br />District. The land use designation is LD -2, Low Density <br />District. <br />ALTERNATIVES & ANALYSIS: <br />The request has been reviewed by Southern Bell, Florida.Power & <br />Light, City Utilities Department, Florida Cablevision Corpora- <br />tion, and the Indian River County Utility and Right-of-way <br />Departments. Based upon their reviews, there are no objections <br />to the release of the easements. The zoning staff analysis, <br />which included a site visit, showed that the drainage would be <br />adequately handled on-site. <br />RECOMMENDATION: <br />Staff recommends to the Board, through adoption of a resolu- <br />tion, the release of the rear lot ten (10) foot easement of <br />Lots 11 & 12, Wallace Acres Subdivision, being the northerly <br />ten (10) feet of Lots 11 & 12, Wallace Acres Subdivision, as <br />recorded in th Public Records of Indian River County, Florida. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Eggert, the Board unanimously adopted <br />Resolution 86-112, releasing the 10 -ft. rear lot <br />easement of Lots 11 & 12, Wallace Acres Subdivision, as <br />requested by Francis and Elizabeth Kelly. <br />16 <br />Book 66 Fa t 7C-3 <br />
