JAN 6 98 - <br />BOOK 66 <br />Property Owners Association is to be responsible, and there is an <br />agreement in here that is binding on them requiring them to <br />comply with the maintenance plan. <br />Commissioner Bowman was concerned about enforcement and did <br />not feel that this agreement has any teeth in it. <br />Planning Director Keating clarified that this is just a <br />formalization of the agreement that is implementing all of the <br />other specifics we have in place through the estuarine plan, the <br />Development Order, etc., and staff will be much more specific on <br />each phase when the land development permits are issued. <br />Attorney Barkett further noted that this is a contract; we <br />can enforce it in circuit court just as we can any other <br />contract; and this agreement goes on for years into the future. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bowman, the Board unanimously (4-0) approved <br />the Maintenance Agreement for the Grand Harbor Estuary <br />System. <br />SAID AGREEMENT IS ON FILE IN THE OFFICE OF CLERK TO THE BOARD. <br />I.
