Planner Shearer explained that when we adopted the Non- <br />residential Conversion Ordinance, staff admitted that they <br />inadvertently may have missed something, and the Board directed <br />staff to initiate proceedings to correct the situation in the <br />event it was found that something had been overlooked. Staff <br />subsequently discovered the subject mixed-use structure had been <br />in use about 20 years. <br />Discussion ensued regarding Limited Commercial, and Commis- <br />sioner Bowman wanted to know if OCR wouldn't be more appropriate. <br />Planner Shearer felt it would but noted that staff was <br />trying to restore the use as a TV repair business. CL was <br />advertised, but we could downzone from that. <br />Chairman Scurlock believed if the use has not been main- <br />tained over a certain period of time, it cannot be reinstated or <br />grandfathered in, but Planner Shearer explained that staff based <br />the use on the date of adoption of the Comprehensive Plan, which <br />grandfathered in non -conforming uses then in existence. This <br />property was in use as a television repair business at that time; <br />although, it was not at the time of the conversion. He noted <br />that OCR would allow an officetype use, and he believed the <br />proposed use now is for real estate offices. <br />Commissioner Bowman preferred OCR because this property is <br />in the middle of a residential area, and the Chairman concurred. <br />The Chairman asked if anyone present wished to be heard. <br />Anthony Walluk, a realtor who is interested in having an <br />office on this property, confirmed that it was previously in use <br />as a TV repair business and further advised that the lady who <br />owns this property has a license to use it as a plant nursery <br />also. <br />It was explained that while offices would be allowed in OCR, <br />a plant nursery would not, and Commissioner Bowman asked if the <br />nursery is a viable business. <br />Mrs. Erika Bomhard of State Road 512 informed the Board that <br />her late husband was a TV repairman and that she has had a small <br />27 BOOK <br />
