■ <br />M <br />Chairman Scurlock -asked whether this would apply to people <br />transporting empty containers to the landfill, and Attorney <br />Wilson did not believe the ordinance would apply to contains ____ <br />where there are just traces remaining in containers. <br />Commissioner Bowman asked if this covered parking lots, and <br />Attorney Wilson stated that this covers public parking lots. <br />Attorney Vitunac further explained that to the extent that <br />any parking lot is public, then this would apply; however, we <br />cannot say definitely that this ordinance will cover private <br />parking lots in malls, etc. <br />Attorney Wilson stated that primarily this law will provide <br />a law enforcement officer with probable cause to stop and <br />investigate when he sees someone driving with a can of beer held <br />to his lips or someone sitting on the side of the road drinking. <br />Chairman opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. <br />Linda Woodard, President of Indian River County Chapter of <br />Mothers Against Drunk Drivers (MADD), stated that she and several <br />others are here this morning to show their support for this <br />ordinance. She pointed out that Indian River County will be the <br />12th county in the state to adopt an ordinance of this kind. <br />When the Legislature meets this April, one of their top <br />priorities will be getting this legislation passed statewide. <br />Chairman Scurlock thanked Mrs. Woodard for the tremendous <br />effort she and other members of MADD have put into getting this <br />ordinance before the Board. <br />Dr. Robert Vinson asked if this ordinance would apply to a <br />recreational motor vehicle, and it was confirmed that it would. <br />William Koolage, 815 26th Avenue, emphasized his support for <br />the proposed ordinance. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously closed <br />the Public Hearing. <br />23 <br />BOOK 66 PAGES A <br />
