JAN 13 1997 <br />BOOK <br />Chairman Scurlock believed that Ralmar would have to rework <br />the plan so that they get no more than 2 upa. <br />Director Keating asked if the Board wants the opportunity to <br />review the revised PRD conceptual plan at 2 upa, and Attorney <br />Vitunac advised that if the Board's approval is such that the <br />developer can satisfy the conditions, it already has been <br />approved. However, if the Board wants to see it again, then it <br />really would not be approved. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />was voted on and carried by a vote of 4-1, Commissioner <br />Bird dissenting. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, the Board unanimously instructed <br />the Planning Department to proceed with a Public <br />Hearing for the RS -2 zoning district. <br />Director Keating asked about our ability to impose a <br />moratorium on anything more than RS -2 in the area, and asked if <br />it would preclude them from coming in with a standard subdivision <br />under the RS -3. <br />Attorney Vitunac repeated that we may not be able to impose <br />a moratorium unless there have been some changes in the <br />moratorium law in the last month. <br />Chairman Scurlock pointed out that according to our Comp <br />Plan, if the trips per day were to exceed the capacity of that <br />road, then we would have a moratorium on the road under any <br />circumstance. <br />Director Keating asked if we could go ahead and advertise <br />for RS -2 for this entire area even though the RS -2 has not been <br />before the Board. <br />Attorney Vitunac did not feel we should do that, because the <br />reason for advertising is to give people the opportunity to come <br />48 <br />
