r JAN 3.3 1987 <br />BOOK 66 ' :'vt 9'?'4 <br />Based on the purpose and intent sections of the CL and CG <br />districts and the definition of general retail sales and services <br />in the definitions section of the zoning ordinance, the staff has <br />concluded that the CL district is primarily intended to allow <br />convenience sales of nondurable goods while the CG district is <br />intended to allow the sale of nondurable as well as durable goods.... <br />This is consistent with the intent to structure CG areas as major <br />shopping destinations and principaltrafficattractors. However, <br />in the current zoning code most of the uses listed under the <br />definition of general retail sales and services are permitted uses <br />in both the CL and CG districts. Moreover, those uses not listed <br />as permitted uses in the CL district are allowed as administrative <br />permit uses. ' - <br />The applicants have observed that in the CL district the County <br />puts a size limitation on department stores and variety stores but <br />does not put a size limitation on grocery stores, drug stores or <br />any other use. The applicants also indicate that it is difficult <br />to determine the differences among large drug stores, department <br />stores, and variety stores. Staff attempted to determine the <br />differences among these types of stores and found none of those <br />uses are defined by the County's zoning ordinances. Where the <br />zoning code does not define specific uses, the common definitions <br />of those uses must be utilized for determining their similarities <br />and differences. <br />Webster's Dictionary provides the following definitions: <br />department store: a store selling a wide variety of goods and <br />arranged in several departments; <br />drugstore: a retail store where medicines and miscellaneous <br />articles (as food, cosmetics, and film) are sold; <br />variety store: a retail store that carries a large variety of <br />merchandise especially of low unit value. <br />However, staff discovered that many businesses in the County <br />listed under the department store or pharmacy heading could also <br />be classified as apparel stores, grocery stores, or some other <br />use. For example, the following businesses are listed as <br />department stores: <br />1) Alma Lee's; <br />2) Dollar General Stores; <br />3) J Byron's; <br />4) Mr. Smoke's; <br />5) J C Penney Co. Inc.; <br />6) Wodtke's; and <br />7) Woolworth's. <br />Moreover, the following businesses are listed as pharmacies: <br />1) Albertson's; <br />2) Eckerd Drugs; <br />3) Ed's Apothecary; <br />4) Gray Drug Stores; <br />5) Perkins; and <br />6) Walgreen's <br />---The-- researched the approximate size of the above cited <br />businesses located within the County and determined that all of <br />these businesses are between 5,000 and 40,000 square feet and that <br />the following businesses would not be permitted to be larger than <br />5,000 square feet if located within the CL district because staff <br />would consider them a department store or variety store: <br />76 <br />
