De <br />FROM: Director REFERENCES: <br />General Services <br />On October 28, 1986, we entered into a two year contract with <br />Sebastian Plumbing, Inc. for a location on the Hobart Tower at the <br />190 foot level. <br />Lucian Rizio, President of the firm, has requested by letter that the <br />lease be cancelled due to a change in their area of operation. Their <br />written request received by me on January 14, 1987, is to discontinue <br />their lease as of December 1st. Their lease provides for <br />cancellation for the reasons given upon sixty (60) days written <br />notice. <br />Staff recommends approval of this cancellation as specified in the <br />lease agreement, effective December 1st, 1986. <br />Commissioner Bowman had a problem with the termination of <br />the lease because they should have given 60 days notice, <br />according to the contract. They gave notice on November 18th <br />for termination on December 1st. The difference in the lease <br />amounts to approximately $250. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, the Board unanimously denied <br />the December 1st cancellation of the Hobart Tower <br />Lease Agreement with Sebastian Plumbing. <br />M.
