JAN 2 7 1987 BOOK �F7 PACE <br />financing on this, the developer would not be able to cloak the <br />payment of membership fees by putting them in the cost of the <br />unit. In fact, it would be much to his disadvantage to do that <br />because of his relationship with his lender. <br />Attorney Vitunac was not sure whether we could enforce a <br />specific membership fee for a private club, but pointed out that <br />a membership fee is one incident in the whole picture of what <br />makes a private club or a commercial club. He stressed that if <br />we ever got into an issue of trying to shut them down for <br />violating their special exception, we would show the membership <br />fee withdrawals as one of the factors. He felt it is partially <br />enforceable. <br />Attorney Henderson advised that the County Attorney's <br />office has condominium documents on the first two phases of the <br />Grand Harbor project and believed that no provision is made for <br />permitting short term leases on the hotel suites, as they are <br />more of the standard condominium variety for longer terms. <br />Chairman Scurlock felt that basically the developer is <br />planning to use these ancillary facilities as a marketing tool, <br />and it seemed to him that most of the use would be by <br />prospective buyers staying in the hotel suites. <br />Attorney Henderson felt that it would be similar to the <br />activities at Johns Island.for the last 15 years, but <br />Commissioner Eggert believed it was 13 out of the last 15 years, <br />and noted that activity no longer exists. <br />Attorney Henderson pointed out that Island House has become <br />exactly what they anticipate this hotel to become, but <br />Commissioner Eggert stressed that to have condominium documents <br />now does not mean they cannot be changed. <br />Attorney Henderson agreed, but felt that all they can do is <br />show that their intent a!nd approach along these lines has been <br />in good faith. He stated that they are willing to agree to <br />conditions if the County Attorney feels that they are legally <br />enforceable, or even if he doesn't. <br />31 <br />
