REMS <br />Code Enforcement Officer <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of January 27, 1987. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Nancy Jo Madsen, Trustee for <br />the Madsen Children Trust Account, owners of the subject <br />property, for the release of the easterly three (3) feet of the <br />westerly ten (10) foot utility easement, being the easterly <br />three (3) feet of the westerly ten feet of Lot 79, Castaway <br />Cove Subdivision Wave 1, Section 08, Township 33, Range 40 <br />East, Indian River County, Florida; according to Plat thereof <br />as recorded in the official Record Book 09, Page 85. It is the <br />Petitioner's intention to construct a swimming pool, and <br />associated fence enclosure; the release of easement is reques- <br />ted in an effort to satisfy zoning regulations requiring a <br />pool to be setback ten (10) feet from the rear property line, <br />or five (5) feet to any easement, whichever is greater <br />(25 (b) (6) (a) , Appendix A,, Indian River County Code) . <br />The current zoning classification is RS -3, Single -Family <br />Residential District. The Land Use Designation is LD -1, Low <br />Density Residential, allowing up to three (3) units per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell Telephone, Vero <br />Beach Power Company, Indian River Cablevision Corporation, and <br />the Indian River County Utility and Right -of -Way Departments. <br />Based upon their reviews, the only acknowledged requirement is <br />that the location of cablevision lines within the easement be <br />identified prior to construction. Staff analysis indicates that <br />drainage would still be adequately handled on-site. <br />RECOMMENDATION: <br />Staff recommends to the Board, through adoption of a reso- <br />lution, the release of the easterly three (3) feet of the <br />westerly ten (10) foot utility easement of Lot 79, Castaway <br />Cove Subdivision Wave 1, being the easterly three (3) feet of <br />the westerly ten (10) feet of Lot 79, Castaway Cove Subdivision <br />Wave 1, Section 08, Township 33, Range 40 East, Plat Book 09, <br />Page 85, of the Public Records of Indian River County, Florida. <br />
