Vitunac, County Attorney <br />DATE: January 28, 1987 <br />RE: AGENDA - BCC MEETING 2/3/87 <br />COUNTY ATTORNEY'S MATTERS <br />SEBASTIAN UTILITY FRANCHISE AND <br />EXECUTION OF INTERGOVERNMENTAL AGREEMENT <br />At its last city council meeting, the City of Sebastian <br />executed a franchise agreement with Indian River County <br />which gives the County the exclusive right to provide water <br />and sewer service to the City of Sebastian which is not <br />presently covered by other franchises. In addition the City <br />authorized the execution of an intergovernmental agreement <br />required by the County's bond counsel as a condition <br />precedent to the sale of bonds to be secured by fees in lieu <br />of impact fee. <br />For the franchise to be effective it is necessary for the <br />County to accept the franchise and execute the inter- <br />governmental agreement. <br />Chairman Scurlock felt this is absolutely historic and could <br />not say enough about Sebastian and their effort to cooperate with <br />the County. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bird, the Board unanimously accepted the <br />franchise described -above, adopted Resolution 87-17 <br />approving the intergovernmental agreement with the <br />City of Sebastian and authorized the Chairman to <br />execute same. <br />45 <br />FE B 3 1907 <br />
