Attorney <br />Henderson emphasized that the parcel in question is unique in <br />that it has road frontage on three sides; however, it seems the <br />approach has been to stop commercial development in the middle of <br />the block, which they feel ignores certain principles established <br />by the Land Use Plan re the use of certain natural boundaries <br />such as roads, canals, etc. <br />Attorney Henderson argued that any traffic problem on 6th <br />Avenue will be alleviated by the extension of Indian River <br />Boulevard south and he did not understand the argument that it <br />would be spot zoning as it would be an natural extension of the <br />existing commercial uses. He admitted there is existing <br />residential which would call for some tough buffering require- <br />ments, but the applicant is agreeable to that. Attorney <br />Henderson informed the Board that the applicant already has <br />recorded a Declaration of Restrictions on this property in an <br />attempt to create a sort of hybrid zone which would have some <br />very limited uses. The Declaration contains the following <br />restrictions and provisions: <br />1.
