Planner Shearer clarified that what we are looking at today <br />is changing the Land Use Designation only on the 250 acres which <br />are shaded, and what Commissioner Eggert is looking at in <br />addition to that is the 216 acres deleted from this request in <br />October, which she thinks should be reconsidered. He noted that <br />as an interim step, the Board could direct staff to initiate <br />downzoning that property to RS -3 and set the process in motion to <br />look at the other proposal to change the Land Use designation on <br />it to LD -1. Commissioner Eggert is concerned that if the shaded <br />area is changed to LD -1 now, these people would be surrounded by <br />RS -6 with a Land Use designation of LD -2, and she is wondering if <br />you would consider her request before you consider locking these <br />people in. <br />Chairman Scurlock believed Commissioner Eggert's problem is <br />that there may be a time delay and conceivably people could go <br />ahead and vest themselves at the higher density. <br />Commissioner Bird felt we are leaving the people more in <br />jeopardy by not taking action than by entrapping them. <br />Commissioner Wheeler believed there are three votes that <br />agree with Commissioner Eggert's position. <br />Discussion ensued regarding the length of time required for <br />a rezoning. Chairman Scurlock noted that the request we are <br />considering today is taking the 250 acres from LD -2 to LD -1 and <br />the zoning remains the same (RS -3). He felt the proper action <br />today would be to go ahead and take the subject property to LD -1, <br />take our chances for that period of time, and then see what the <br />majority wants to do in regard to rezoning of the other acreage. <br />The Chairman asked if anyone present wished to be heard. <br />Attorney Sam Block came before the Board representing the <br />Winter Beach Progressive League. He noted that this really all <br />started because of the concern of those living in the area as to <br />how their area would be developed. They agree with Commissioner <br />Eggert and would like the whole 466 acres to be addressed again <br />so there is a complete picture out there.
