Commissioner Bird entered the meeting at 1:40 P.M. <br />Public Works Director Davis informed the Board that Assist- <br />ant County Attorney Barkett had a few concerns on this item. <br />Basically he was concerned with waiving the stormwater permit, <br />and felt in lieu of waiving it, we should help the applicant in <br />complying with it. <br />Chairman Scurlock had a problem with waiving the permit, <br />even if we could do so, and felt we should follow the required <br />procedures. Board members concurred. <br />In discussion Director Davis noted that, in other words, <br />staff is to work up the application for Mr. Sullivan and do the <br />engineering, and the Chairman agreed. <br />Director Davis advised that another of Attorney Barkett's <br />concerns was with the wording in regard to abandonment to "the <br />abutting property owners." He felt it should read that there <br />just be an abandonment and the rest of the language omitted. <br />Attorney Vitunac clarified that in our standard abandonment <br />rather than doing a title.search and naming anyone, we just <br />abandon and let them do the search. <br />Director Davis noted that staff has been working to imple- <br />ment a major drainage system for this area for quite a time and <br />is getting down to the last easements required. An assessment <br />project is anticipated, and we are subject to getting permits <br />from the Drainage Districts and all agencies involved. If we <br />can't get the permits, we can't do the project, in which case Mr. <br />Sullivan would still use this area for storm water management. <br />Commissioner Bird commended Director Davis for his work. <br />ON MOTION by Commissioner Bowman, SECONDED by Com- <br />missioner Eggert, the Board unanimously approved the <br />Developer's Agreement A with the revisions recommended <br />by staff and with the modifications discussed above. <br />(SAID AGREEMENT TO BE MADE PART OF THE RECORD WHEN RECEIVED.) <br />69 <br />L_FES I "d '�07 <br />
