FEB <br />BOOK 6 <br />DESCRIPTION AND CONDITIONS: <br />On January 27, 1987, the Board of County --Commissioners autho- <br />rized staff to draft a code enforcement board ordinance amend- <br />ment and schedule a public hearing for its adoption. The basis' <br />for the amending ordinance is to reflect changes made to <br />Section 162.01 of the Florida Statutes, et seg., which was <br />amended by the State Legislature in the 1986 Session. Section <br />162.01 of the Florida Statutes, et. seq., authorizes local code <br />enforcement boards -and governs their procedure. <br />With reference to changes made at the State level, the proposed <br />amendments would clarify the following in the County's Code <br />Enforcement Board ordinance: <br />If a case is scheduled for an evidentiary hearing, and a <br />violation is corrected and then recurs, the case shall be <br />presented to the Code Enforcement Board even if the <br />violation has been corrected prior -to a Board hearing; <br />If an order of the Code Enforcement Board has not been <br />complied with by a set time, or if the same violation is <br />repeated by the same violator, a fine may be imposed for <br />each day the violation continues past a set compliance <br />date, and a hearing shall not be necessary for issuance of <br />the order; - <br />No lien created pursuant to the provisions of the Code <br />Enforcement Board ordinance may be foreclosed on real <br />property which is a homestead under Section 4, Article X <br />of the State Constitution; and <br />No lien filed against a property for a violation shall _ <br />continue for a period longer than five (5) years after <br />recording, unless within that time an action to foreclose <br />on the lien is commenced (changed from the present two (2) <br />maximum time limit for foreclosure commencement). <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve <br />the proposed ordinance amendment for adoption. <br />Attorney Vitunac explained that this amendment brings the <br />old Code Enforcement Ordinance into compliance with the State. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. There being none, the <br />Chairman declared the Public Hearing closed. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously adopted <br />Ordinance 87-23, amending that part of the Code of Laws <br />and Ordinances entitled "Code Enforcement Board". <br />54 <br />
