Commissioner Wheeler suggested that instead of correcting <br />that situation with an ordinance on the road frontage, we <br />establish the requirement of having a recorded easement across <br />the property so that it is part of the deed and is there forever. <br />Planner Stan Boling felt that standards need to be <br />established, because there are problems with road upkeep even <br />when there.is a recorded private easement. Furthermore, if a <br />parcel does not have access on a dedicated road right-of-way, <br />there may be problems getting utilities back there. <br />Commissioner Wheeler pointed out that there are many 5 acre <br />1300-1400 ft. deep parcels, which could be rezoned rural <br />residential at 2-1/2 upa and have a common driveway by the use of <br />an easement. <br />Director Keating advised that a recent change in the <br />subdivision ordinance makes it allowable to do a road plat that <br />can facilitate a lot split, whereby the road does not have to be <br />paved. However, the road has to be created. Basically, that <br />provides a means without going through a major expense for a <br />one -lot split. <br />Mr. Boling pointed out that the Floyds do not have that <br />option because they only have 35 feet. <br />Commissioner Wheeler asked if in this specific case where <br />there would be one house, whether he would be allowed to have <br />ingress and egress off of 133th Street. <br />Mr. Boling believed he probably would be able to get a <br />right-of-way permit from Public Works for both access points, but <br />pointed out again that the reason he is allowed to build is <br />because his lot was created back in 1913 before we had any <br />requirements for frontage and was grandfathered in. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. <br />Fred Mensing, resident of Roseland, advised that he is <br />representing the Floyds. He believed the property to be very <br />unique for the reason that the U-shaped piece that surrounds Lot <br />
