MAR 10 1997 - BOOK 6 r- 5 4 <br />At the February 26, 1987 regularly scheduled Planning Commission <br />Meeting, the Planning Commission considered this request. <br />RECOMMENDATION <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners approve the proposed amendments to the <br />existing County Ordinances regulating construction seaward of <br />the coastal construction control line. <br />Michael Miller, Chief of Environmental Planning, reported <br />that the Governor and Cabinet have approved the proposed con- <br />struction control line. With the adoption of this ordinance, the <br />State will be able to issue permits for these structures in <br />Indian River County. Staff is recommending adoption of this <br />ordinance because we are not sure that we have the same expertise <br />that the State has with regard to structural engineering require- <br />ments in the building codes. In addition, we have been advised <br />by our Legal Dept. that it might not be wise, for liability <br />reasons, for us to prohibit the building of a structure when a <br />State agency is authorizing construction. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard. There being none, he declared the <br />Public Hearing closed. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Bird, that the Board adopt Ordinance <br />87-26, amending the County Code of Laws and Ordinances <br />with regard to construction of structures seaward of <br />the coastal construction control line established by <br />the Florida Dept. of Natural Resources. <br />Under discussion, Mr. Miller pointed out that the State's <br />building standards are much higher than ours. <br />0 Director Keating recommended that theBoarddirect the staff <br />to bring back some changes to the tree protection ordinance in <br />23 <br />
