MAR 10 1987 Bou 7 Farr 617 <br />Commissioner Bird noted that if we end up in litigation on <br />this, the Architect's recommendation would weigh pretty heavily <br />in a court of law. <br />Mr. Carroll did not feel we would end up in litigation over <br />the amount of money involved in the 8 -penalty. He stated that <br />they would work with the County in clarifying and interpreting <br />the contract documents. <br />Commissioner Bird asked Mr. Carroll how he felt about the <br />County not paying the two interest expenses since we made every <br />attempt to pay the bills in the almost impossible turn around <br />time of 10 days, and Mr. Carroll believed that whoever wrote that <br />clause into the contract misunderstood the process. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously <br />approved staff's recommendation that Items <br />5, 6, 9, 10, and 12 not be paid; and that the <br />Contractor be penalized for 40 days for not <br />completing construction of the Jail on time <br />according to the Contract. <br />
