HIGHLAND MOTEL, DEMOLITION LIEN <br />The Board reviewed the following memo dated 3/18/87: <br />TO: The Board of County Commissioners <br />DATE: March 18, 1987 <br />SUBJECT: Highland Motel - Demolition Lien <br />FROM: James P. Wilson <br />Assistant County Attorney <br />J <br />On February 16, 1983, the Board of County Commissioners of <br />Indian River County approved the demolition of the Highland <br />Motel located near the entrance of Sebastian Highlands, as a <br />nuisance structure. The County Road and Bridge Department <br />destroyed the building and incurred costs of $9,150.29. A <br />lien was filed to secure payment of the demolition costs <br />which are unpaid and accruing interest at the rate of 12% <br />since April 8, 1983. The accrued interest, calculated <br />through March 24, 1987, is $4,343.99. <br />The property was recently purchased at tax auction by the <br />Sebastian General Partnership. Earl Witherby, agent for the <br />Sebastian General Partnership, has contacted me and offered <br />to settle this matter by paying the principal amount. The, <br />Board must determine whether to accept this amount and waive <br />payment of the accrued interest or contest the lien in a <br />future possible legal action. I will be available at the <br />meeting of March 24th to discuss this matter with the Board <br />so that 1 may relay your decision to Mr. Witherby. <br />Assistant County Attorney Jim Wilson advised that the Board <br />must determine whether to accept this amount and waive payment of <br />the accrued interest or contest the lien in a possible future <br />legal action. There is a possibility that we may not be able to <br />collect any of the costs, but he believed we would have a better <br />than 50-50 chance of winning in court. They have agreed to pay <br />everything but the interest. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously denied <br />the request by Sebastian General Partnership to waive <br />the payment of accrued interest. <br />110 <br />1987 <br />BOOK l PACE <br />
