REFERENCES: waverly place <br />Chief, Current Development STAN4 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of March 24, 1987. <br />DESCRIPTION & CONDITIONS: <br />In November of 1979, the County approved a major site plan <br />application to construct a condominium project known as Tropic <br />Villas South (now known as Waverly Place) on ±26.82 acres located <br />on the east side of 6th Avenue at 10th Street [see attachment #11. <br />At the time of approval, the site was zoned R-2 (Multiple -family) <br />which allowed up to 15 units/acre. The approved plan proposed 348 <br />units at a density of 12.97 units/acre. Subsequently, a site plan <br />modification was approved by the Planning and Zoning Commission on <br />October 13, 1983 which, among other things, reduced the overall <br />density to 11.78 units/acre (316 total units). The plans called <br />for 7 phases which were to be "platted -over" as land condominiums <br />[see attachment #21. <br />Presently, 112 units are built and occupied on the central 9.36 <br />acres of the project, comprising Tropic Villas South and phases 1 <br />and 2 (all platted), at a density of 11.96 units/acre. Some <br />infrastructure improvements for the remaining phases of the <br />project have been constructed, and preliminary plats to lay over <br />the approved site plans have been approved. Building permits for <br />constructing phase 3 units (total of 40) were obtained, and con- <br />struction started on the units. However, the last phase 3 <br />building inspection was conducted in December of 1985. Since that <br />time, no active building permits have been maintained and con- <br />struction has been abandoned. The 40 units are approximately 80% <br />complete, with some interior and finishing work remaining. The <br />overall project is almost 3 years behind its construction/ com- <br />pletion schedule [see attachment #3] <br />Pursuant to section 23.1(g)(3) of the site plan ordinance, the <br />Board of County Commissioners can terminate site plan approval <br />after notice (to the owner) and a hearing if it is determined that <br />construction has been abandoned or suspended. Construction is <br />considered abandoned or suspended if an active building permit has <br />not been maintained for construction or if it is shown that a good <br />faith effort to proceed with the project has not occurred for a <br />continuous period of 6 months [see attachment #4]. <br />91 <br />
