BARTON Q.�-' <br />ASSISTANT DIRECTOR OF UTILITY SERVICES ZJ <br />SUBJECT: AGREEMENT BETWEEN INDIAN RIVER COUNTY AND HAWK'S NEST <br />ASSOCIATES, LTD. FOR DELIVERY AND USE OF RECLAIMED WATER <br />BACKGROUND <br />As part of the Gifford Sewer Project, the Division of Utilities <br />Service has been entering into agreements with golf courses within the <br />area for delivery and use of reclaimed water. The attached agreement <br />is the last agreement needed to complete the requirements of the <br />Department of Environmental Regulation for the issuance of our permits <br />for the Gifford Sewer Plant. <br />RECOMMENDATION <br />The Division of Utility Services recommends to the Board of County <br />Commissioners that they approve the agreement and authorize the <br />Chairman, on behalf of the County, to sign the agreement after its <br />execution by Hawk's Nest Associates, Ltd. <br />County Attorney Vitunac advised that he received a call <br />yesterday from Attorney Bill Caldwell representing the Hawk's <br />Nest in regard to a change in the agreement. Hawk's Nest had <br />agreed to a one million gpd right to dispose of effluent on the <br />golf course, and there would be no charge on that one million. <br />The agreement reached by Attorney Caldwell and Director Pinto was <br />that this figure would drop to 700,000 gpd maximum guaranteed, <br />and we may charge for anything over that, but-A-ey will accept <br />the excess only by mutual agreement. <br />This was confirmed by Attorney Caldwell. <br />On Motion by Commissioner Bird, SECONDED by Com- <br />missioner Wheeler, the Board unanimously approved <br />the Agreement with Hawk's Nest Associates, Ltd., <br />with the above modification. <br />(AGREEMENT WILL BE MADE A PART OF THE RECORD WHEN FULLY <br />EXECUTED AND RECEIVED.) <br />21 <br />BOOP f��E� <br />
