liability arising as a result of injuries sustained from use of a jet ski, the <br />County certainly would be deemed to have the deepest pockets. Therefore, Kevin <br />Healy must indemnify and protect the County from all costs whatsoever. <br />I have spoken with Mr. Healy and informed him this would be my recommendation <br />to the Board of County Commissioners. I further informed him that the most _ <br />acceptable attestation of this policy would be the original copy or a true certi- <br />fied copy of an insurance policy with such limits as well as the original copies <br />or certified true copies of all endorsements thereto. <br />I recognize that this requirement may place an onerous burden on Mr. Healy; <br />however, there is absolutely no reason the taxpayers of Indian River County <br />should be exposed to ptential catastrophic losses arising from litigation. <br />In fact, this philosophy should be applied with respect to all such agreements <br />the County may enter into. <br />Assistant County Attorney Barkett noted that the contract <br />calls for Mr. Healy to indemnify the county and provide <br />insurance. <br />Chairman Scurlock expressed concern about the Causeway <br />becoming a carnival - we have the sailboards there already, and <br />where do you. stop? He believed some of the adjacent residents <br />are impacted by the activity, and we have received letters <br />expressing concern about the noise that would be generated by the <br />jet skis. <br />Commissioner Bowman pointed out that the southern limit of <br />the Pelican Island National Wildlife Refuge is right there at the <br />base of the island to the north (Preacher's Island.) <br />Kevin Healy, applicant, advised that he proposed to limit <br />the jet ski area. They do have a list of rules; they have only <br />three skis; and he felt he could control the operation within the <br />limited area. The hours he is requesting would be 11:00 A.M. to <br />4:00 P.M. only on weekends and holidays, and he has talked to a <br />marine biologist and would agree to suspend activity in the <br />spawning season for sea trout. Further, the skis have been <br />insulated for noise and have been throttled down. <br />Commissioner Bird questioned if the project would be econom- <br />ically viable operating only on weekends and holidays and not at <br />all in the months of spawning season between May and September. <br />Mr. Healy explained that this is not his sole means of <br />income; obviously it would affect it, but it is the seasonal <br />tourist he is looking for.
