The Chairman asked if anyone present wished to be heard. <br />Attorney Bennett Rabin of Sam Block's office appeared on <br />behalf of Ralmar Associates who own the parcel on the northwest <br />corner of the entire tract being reviewed. He requested that <br />their parcel be deleted from the consideration today, emphasizing <br />that Ralmar is opposed to rezoning the entire area and particu- <br />larly to the rezoning of its parcel. Attorney Rabin stressed <br />that the Ralmar property is unique; no other parcel within the <br />area is bordered by two canals. Directly north is the main <br />relief canal; further north is the commercial area and the <br />electrical plant; directly west is King's Highway, a major <br />thoroughfare and the secondary relief canal; and to the south is <br />16th Street. Most importantly, Ralmar is opposed to the rezoning <br />to RS -2 because of the earlier rezoning to RS -3. Attorney Rabin <br />felt the law is clear that any citizen is entitled to rely on the <br />assurances and commitments of a zoning authority, and he de- <br />scribed how Ralmar worked with staff to develop the area in <br />accordance with the zoning designation, stressing the monies and <br />effort expended, all of which was done in good faith as a result <br />of this Board's actions in rezoning to RS -3. He, therefore, <br />asked that Ralmar's property be deleted from the proposed <br />rezoning to RS -2. <br />George Beuttell, resident of Rosewood Road, spoke in favor <br />of the rezoning to RS -2. He noted that the Ralmar people have <br />continued to come in and get zoning which is contrary to the <br />nature of the development along Rosewood Road and that they <br />bought the property even though they knew they would have a very <br />difficult time trying to rezone it. Mr. Beuttell emphasized that <br />Rosewood Road is developed mainly in estatesize parcels and <br />taking the Ralmar property out of the proposed rezoning would <br />lessen the value of the existing properties.
