Mr. Strazzulla pointed out that his firm has been <br />cooperative in donating land for the Indian River Boulevard <br />extension project, and they would not feel very good if they were <br />stuck with a very stiff fine for something that was certainly <br />unintentional. <br />Doug Flynn, of Dennis Smith, Inc., confirmed that they did <br />contract with the Strazzullas to do the clearing on the west of <br />the Boulevard and inadvertently did get some machinery on the <br />east side. They were not aware there were any mangroves in that <br />half acre of land, but apparently they did get approximately ten, <br />which Planner DeBlois has admitted were sparcely mixed. Mr. <br />Flynn advised that they have ordered 30 plants to replace the 10; <br />it was entirely an accident; and they are trying to make <br />restitution. <br />Chairman Scurlock noted that, in other words, a biologist <br />had been retained to help develop the site; there was no intent <br />to remove the mangroves deliberately; and they are trying to <br />mitigate. <br />Mr. Strazzulla agreed they will immediately mitigate <br />whatever is necessary, but noted in their plans to develop, they <br />may have to go back through the various agencies in regard to <br />removing more of those. He advised that he has a statement from <br />Reese Kessler, an environmental consultant, that those mangroves <br />have no environmental value and again stressed that they are not <br />in the tidal area but in puddles. <br />Commissioner Bowman informed Mr. Strazzulla that white <br />mangroves cannot usually grow in water; so whether or not they <br />were in water has nothing to do with it. She believed they <br />should have had their consultant go in and flag those plants and <br />noted that the state regulations are very lax and they should <br />abide by the county regulations.
