A similar request was made last year for the County <br />to maintain and pave 10th Court Southwest. The County then accepted 10th <br />Court Southwest for maintenance and began a lengthy right-of-way acquisi- <br />tion process. The final parcel is being condemned. <br />ALTERNPiTIV M AND ANALYSIS <br />Staff has estimated the cost to pave the three roads at $113,400. Various <br />property owners along the roadways have signed consent forms to cooperate <br />in conveying right-of-way to the County. In the past, this procedure has <br />been lengthy due to the need for mortgage releases, title searches, prob- <br />lems with legal descriptions, etc. If the County elects to assume mainte- <br />nance of the roads, staff is of the opinion that the Road and Bridge <br />Division should first maintain the roads for a four-year period, after <br />which a "maintenance map" can be filed to establish legal right-of-way. <br />After this four-year period, petition paving could be scheduled. <br />RECCMWATION AND FUNDING <br />It is recommended that the County begin maintenance of 9th Avenue South- <br />west, 9th Court Southwest, and 8th Court Southwest at this time. After a <br />four-year period, a maintenance map can be filed and petition paving be <br />implemented. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, to authorize county staff to begin <br />maintenance of 9th Avenue SW, 9th Court SW, and 8th <br />Court SW, at this time, so that a maintenance map may <br />be filed in four years and petition paving implemented. <br />County Attorney Vitunac pointed out that the county must <br />actually construct the road and then maintain it for four years <br />before getting title. He noted we would have to go in with a <br />grader and construct the road to the size we need in the future. <br />Director Davis understood that. He explained that what we <br />have existing is not a road, and we will go in, add material, <br />build a road, and maintain it for four years. <br />THE CHAIRMAN <br />CALLED <br />FOR THE <br />QUESTION. <br />It was voted <br />on and <br />carried <br />unanimously. <br />MISCELLANEOUS INTERSEC.
