r MAY 5 1987 <br />BOOK 68 FADE 230 <br />Mr. Mooney believed it would be at least $15,000 an acre, <br />and Chairman Scurlock noted that would be about 1.5 million. He <br />felt if we really want to preserve that land, we need to try to <br />find a source to enable us to purchase it. <br />Commissioner Bowman commented that when Mr. Mooney bought <br />his property, that was in the dark ages as far as zoning in <br />Indian River County was concerned. She did not think anyone then <br />realized the importance of the sand ridge and the shallow <br />aquifer, but times change, and we have gotten a lot smarter. <br />• Ted Herzog came before the Board as attorney for LaRue <br />Equities, the fee simple title holder to the 102 acres, which is <br />a Florida corporation with three stockholders, Bob Mooney, his <br />sister, and his mother, LaRue Williams. He wished to emphasize <br />that not only has the general development criteria for this <br />property remained the same since approximately 1957, but as <br />recently as October of 1986, there was unanimous approval of the <br />density at RS -6. In addition, they just revisited the Planning & <br />Zoning Commission on this and had a 6 to 1 vote in favor of <br />keeping the density of 6. Based on this, Mr. Mooney and his <br />family - La Rue Equities - went ahead with their development <br />plans. Mr. Herzog contended that this represents detrimental <br />reliance that goes to the vesting issue since all their planning <br />and going to preliminary plat was based on numerous revisitations <br />of this issue during the last 18 months by various Boards of the <br />County. Attorney Herzog continued to emphasize that they are not <br />coming before the Board with a new issue; RS -6 has been stated <br />consistently; and they ask the Commission to maintain that <br />position. <br />William Koolage, 815 26th Avenue, understood this property <br />has been in RS -6 for a number of years. He cited the Rockridge <br />and Rosewood areas, and noted that when you start changing the <br />zoning of people who have had zoning for a long time, you affect <br />their fives.
