can be no question where the sand ridge is, if you use 'the <br />government's standard which is based upon a biological ,,survey. <br />She felt it was obvious that every one of the photographs showed <br />that land to be sand ridge, because if there is scrub pine, scrub <br />oak, or rosemary, it is sand ridge, regardless of the topography. <br />Planner DeBlois advised that the study showed the parcel to <br />be transitional. The southwest corner of the property',is not on <br />the sand ridge, and the remainder is on the ridge. He,disagreed <br />with Mrs. Goetzfried in that a soil bearing test was a', <br />requirement on all 23 transects, and Mrs. Goetzfried emphasized <br />that their client went to a great deal of expense in having these - <br />tests made and they have cooperated in working with staff to <br />determine the location of the sand ridge in order to be allowed <br />to build a lake on the parcel. <br />Robert Mooney, representing LaRue Equities LTD., Pointed out <br />that in some places there are 10 -ft. differences in elevation; <br />however, he did not feel that he paid for anything more than what <br />was required. All the clearing was done for the purpose of <br />getting the preliminary plat, not for the purpose of clearing the <br />property. <br />Commissioner Bird believed that the violation was <br />unintentional and that the property owner has paid dearly for the <br />services of having that clearing done and for all of the points <br />shot to get the elevations. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Wheeler, the Board unanimously (4-0) <br />required an after -the -fact permit for landcliearing at <br />triple the normal required amount. <br />Commissioner Bowman just felt that this is one of the <br />biggest messes that she has ever seen, and that it isltime to <br />review our requirements.
