DISCUSS LAWSUIT RE JAIL <br />Commissioner Wheeler informed the Board that the at <br />lawsuit <br />filed by the state because of overcrowded conditions at the new <br />jail indicate that either we didn't create a Fast Track Committee <br />or that we didn't use it. He advised that he has a meeting <br />tomorrow with Administrator Balczun, OMB Director Baird and the <br />Sheriff to look at the third phase of the Jail. <br />Commissioner Eggert inquired when the minimum security <br />facility is due to open, and Commissioner Wheeler believed it was <br />supposed to be some time in June; however, that won't isolve our <br />problem with overcrowding. He noted that the state isl releasing <br />these offenders early and kicking them back on the street-; then <br />they violate parole with the result that they are stuck in our <br />system until we can move them back to the state prisons. The . <br />state is now suing us because we can't handle the problem they <br />couldn't handle. i <br />Chairman Scurlock felt the push is from the federal level on <br />the state, and then the state pushes it onto the local' gov- <br />ernments. <br />Commissioner Bird inquired about the possibilitylof utiliz- <br />ing the old jail for housing on a temporary basis. <br />Chairman Scurlock pointed out that first of all, it doesn't <br />meet state standards, and in addition, the feeling is that once <br />you occupy it, it will become a permanent situation because of <br />the demand. <br />Commissioner Wheeler advised the idea has been given some <br />consideration, but he did not believe the old jail complies at <br />all, and very possibly the state would not allow us to utilize it <br />for prisoners again. <br />Commissioner Bowman asked if Phase 111 will be blig enough to <br />solve our problems, and Commissioner Wheeler believedlit will <br />21 BOOK Fac <br />
