U <br />TRAFFIC SIGNAL MAINTENANCE AGREEMENT WITH CITY OF SEBASTIAN <br />The Board reviewed the following memo dated 4110107: <br />TO THE HONORABLE MEMBERS OF DATE: April 10, 1987 <br />THE BOARD OF COUNTY COMMISSIONERS <br />THROUGH: <br />Charles P. Orr A0 <br />FROM: Traffic Engineer <br />LE: <br />SUBJECT: Traffic Signal I Maintenance <br />Contract with City of <br />Sebastian <br />REFERENCES: <br />The existing traffic signal maintenance contract ith the City of <br />Sebastian was signed in August 1983. The Coun y now provides <br />maintenance services at cost to the City and the ity assumes all <br />liability. <br />Renewal is necessary at this time to (1) update the County's <br />compensation, and (2) to add a second signal to the mai tenance list. <br />A new contract was submitted to the City for execution but was <br />returned at the recommendation of the City Attorney to modify the <br />liability clause to hold the County responsible for itslown actions. <br />The Assistant County Attorney advises that (1) theliabilityclause <br />in the existing contract with the City assuming all liability be <br />maintained because the County would increase its risk of liability with <br />no corresponding benefit and that (2) the City should provide insurance <br />to cover the County. <br />ALTERNATIVES AND ANALYSIS <br />1) Renew the existing contract with the City assuming all liability and <br />update compensation (Schedule A). The City Attorney has indicated <br />that he would not recommend this to City Council. <br />2) Renew the existing contract with the City assuming all liability <br />and require that the City furnish liability insurance for the <br />County. This is recommended by the County Attorney to provide <br />.maximum protection for the County. <br />3) Amend the contract with a new liability clause, as 'requested by the <br />City Attorney, to hold the County responsible for its own actions; <br />require the City to furnish liability insurance for the County; and <br />update compensation (Schedule A). This alternative is acceptable <br />to the County Attorney upon approval of the insurance to be <br />furnished. <br />4) Terminate the existing contract and do not provide maintenance <br />service to the City. <br />RECOMMENDATION AND FUNDING <br />Alternative #3 is recommended because a valuable l service will be <br />provided to the City of Sebastian and the County liability will be <br />protected. - <br />No additional funding is necessary. <br />cost reimbursements during FY85-86. <br />JUN 0 1981 <br />36 <br />The County re'eived $417.38 in <br />9Q0 F�?uE 544 <br />
