JUL 7.1997 <br />Bou 68 F, a 6,97 <br />TO: The Board of County Commissioners <br />DATE: June 19, 1987 <br />SUBJECT: <br />Filing of Lien to Secure Payment for Removal of <br />Nuisance Structure; Agreement to Pay Cost of <br />Removal <br />FROM: Bruce Barkett"I <br />Assistant County Attorney <br />On January 27, 1987 the Board of County Commissioners deemed <br />the building located on Lot 19, Block 3, Smith Plaza <br />Subdivision unsafe for human occupancy and ordered it <br />demolished. The owner of the building, Katherine Clark, <br />4345 30th Avenue, Vero Beach, Florida, was notified several <br />times prior to demolition of the building (see, example, <br />Attachment No. 1). <br />The actual charges for the demolition of the building are <br />$2,956.26 (Attachment No. 2). Pursuant to Indian River <br />County Code of Laws and Ordinances, Chapter 4, Article 11, <br />Sections 4-16 through 4-24, after removal of the building by <br />the County, the Board of County Commissioners is required to <br />cause a lien for the costs of removal to be filed against <br />the owner of the building. <br />Ms. Clark has indicated that she would like to pay off the <br />lien in installments. An agreement authorizing payment of <br />the principal amount with interest over a period of four <br />years has been drafted for approval by the Board. <br />It is recommended that the Board of County Commissioners: <br />1. Authorize the Chairman to sign the lien for costs <br />incurred by the Board of County Commissioners of Indian <br />River County to remove a nuisance structure from the <br />property located within Indian River County and described as <br />Lot 19, Block 3, Smith Plaza Subdivision, as recorded in <br />Plat Book 1, Page 18, Public Records of Indian River County; <br />2. Authorize acceptance of an agreement and payment <br />schedule to pay off said lien by Katherine Clark; and <br />3. Authorize recording of the necessary documents in the <br />public records. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Wheeler, the Board unanimously approved <br />staff's recommendation as set out above in regard to <br />the building located on Lot 29, Block 3, Smith Plaza <br />Subdivision. <br />20 <br />
