I J <br />71987 <br />BOOK 6 <br />DESCRIPTION & CONDITIONS: <br />In recent years, the desire by automobile dealers to conduct <br />special sales events in locations other than at their approved <br />establishments and involving two or more car dealers has in- <br />creased. At present, however, special car sales events are only <br />allowed on parcels approved for either automobile sales or <br />approved for special events. The transient merchant ordinance, <br />approved by the Board of County Commissioners on March 10, 1987, <br />restricted merchandise sales in non -permanent locations to an <br />even greater.degree. <br />Several months ago, a special car sales event was held by several <br />dealers on an out -parcel at the Luria's Plaza on U.S. #1. <br />Operating without permits, this event caused on-site and off-site <br />traffic circulation problems, was conducted without sanitary <br />facilities, and violated several code provisions (including <br />signage restrictions, adherence to setbacks, and encroachment of <br />right-of-way) with which permanent facilities must comply. <br />Because of controversy resulting from that event, the Board of <br />County Commissioners directed the staff to work with the County's <br />automobile dealers and determine if any code modifications were <br />warranted. Given that directive, the staff then conducted a <br />workshop meeting with interested car dealers. At that meeting, <br />the car dealers expressed their desires, and the staff expressed <br />their concerns and identified alternative courses of action which <br />could be taken to meet the objectives of the automobile dealers. <br />Then, the staff requested and the Board of County Commissioners <br />authorized preparation and advertisement of an ordinance amend- <br />ment allowing temporary sales events and setting standards for <br />said events. <br />At their regular meeting of May 28, 1987, the Planning and zoning <br />Commission voted 3-2 to recommend that the Board approve the <br />proposed ordinance. <br />ALTERNATIVES & ANALYSIS: <br />Prior to its workshop meeting with the car dealers, the staff <br />identified the various alternatives and noted the advantages and <br />disadvantages of each. The attached option analysis provides <br />that information. Of the three options identified, only the <br />off-site TUP location was considered acceptable by the automobile <br />dealers. <br />In assessing the feasibility <br />_ events in off-site locations, <br />major concerns. Finally, the proposed amendment <br />would establish all the necessary standards which would have to <br />be met in conducting a special car sales event. <br />39 <br />
